Red Cross Sued After Boy Nearly Drowns

On January 21, 2014, Rochelle Lanise Scott filed a lawsuit individually and as next friend of Caleb Ryan Smith, a minor, against The American National Red Cross and Jason Thompson.

According to the lawsuit, on June 9, 2009, Caleb was at the League Street North city pool with his daycare. He wandered away and was later found at the bottom of the pool.

Scott alleges that a lifeguard nearby was summoned but did not respond in an appropriate manner. A daycare teacher was forced to jump in to retrieve Caleb.

The American Red Cross and Jason Thompson are accused of improperly training the lifeguard staff present.

According to the lawsuit, young Caleb suffered chronic respiratory failure, spasticity, urinary retention, and anoxic brain injury. He is not expected to function normally ever again. And he requires constant care from his mother in addition to nursing care.

Scott is seeking damages in excess of the jurisdictional limit.
